Our legal form and what it entails

We chose the general partnership knowingly, and it seems useful to us to explain its consequences rather than leave them in the shadows.

Two partners liable on their assets

In a general partnership, the partners are liable for the company's obligations jointly and on all their assets, subsidiarily to the company's own assets, in accordance with art. 568 of the Swiss Code of Obligations. In other words, our liability does not stop at the company's capital. That is a real constraint, and we accept it.

Why our partners are not named on this site

We have decided to publish neither the names nor the portraits of our partners on the site. This choice is a matter of discretion and protection of privacy; it hides nothing. The persons who bind the company appear in the commercial register, with their signing authority, and that information remains accessible to anyone who wants to verify it before contracting with us.

Site hosting

The lyvia.swiss website is hosted in Switzerland by Infomaniak Network SA, a company headquartered in Geneva. The site's files and the technical data linked to its operation are therefore located on infrastructure on Swiss territory.

What this changes and what it does not

Swiss hosting means the infrastructure falls under Swiss law and the supervision of Swiss authorities. It is not enough, however, to guarantee that no data leaves the country, since some components of the site call on services established abroad. We describe these flows precisely in our data protection policy.

Intellectual property of the site

The site, its structure, its texts, its graphic charter, its illustrations and the code that makes it run are protected by the Federal Act on Copyright and Related Rights. Unless otherwise indicated, LYVIA SNC is the owner or holds the rights required for their use.

We regularly cite software and services published by other companies, because it is impossible to explain our work without naming them. These citations call for a clarification we want perfectly clear.

Each brand belongs to its owner

Odoo, Microsoft, Microsoft 365, Outlook, Excel, Power Automate, Google, Google Workspace, Zapier, Make, Notion and bexio, as well as all other product or service names mentioned on this site, are trademarks or registered trademarks of their respective owners. We cite them purely descriptively, to designate the tools we integrate.

No partnership, no licence resale

LYVIA SNC is the publisher of none of this software. It is not an official partner of Odoo or of any other vendor cited, and does not resell licences. The mention of a product on this site therefore expresses neither vendor approval, nor affiliation, nor a distribution mandate.

We do not answer for these products

The operation, availability, security, prices, contractual terms and evolution of this software are the sole responsibility of their vendors. Governing law and jurisdiction

The use of the lyvia.swiss website and the relationships arising from it are governed by Swiss law, to the exclusion of conflict-of-law rules and international sales treaties.

The competent court

The exclusive place of jurisdiction is Fribourg, Switzerland. The mandatory and semi-mandatory forums provided by law remain reserved, in particular the one enjoyed by consumers under art. 32 and 35 of the Swiss Civil Procedure Code, which cannot be waived before the dispute arises.
